Six ministries and commissions jointly proposed clear provisions for centralized bidding and procurement of drugs

Recently, six ministries and commissions, including the State Food and Drug Administration, the Ministry of Health, the National Development and Reform Commission, the State Administration for Industry and Commerce, the State Administration of Traditional Chinese Medicine, and the State Council Correction Office jointly issued notices that set forth clear regulations for further standardizing the centralized bidding and procurement of drugs for medical institutions. Since the nationwide implementation of centralized bidding and procurement of drugs, with the leadership and support of governments at all levels, relevant departments have actively cooperated, defined policies, standardized operations, adhered to the principles of openness, impartiality, and fairness, and the scope of the bidding has been continuously expanded, and the tendering method has been gradually improved, with initial changes. The procurement of medicines by medical institutions increased the transparency of drug prices, increased the market share of high-quality drugs, and curbed the trend of rising drug prices. However, there are still some problems that cannot be ignored in the centralized bidding and procurement of drugs. First, medical institutions sign purchase and sales contracts to determine the quantity of drug purchases, there are a large number of substitute drugs to avoid bidding, and even the phenomenon of “winning a bid and die”; second, the implementation contract is not strict, and medical institutions do not purchase drugs and pay in time according to the contract. The timely contract for medicines; Third, the tender procedure is too cumbersome, too many intermediary agencies to increase the burden on the company; Fourth, some medical institutions did not determine the temporary retail price of the successful bidder according to the relevant state regulations, the benefits of not lowering the price of bidding are mostly beneficial to patients. Fifthly, due to inadequate supervision, medical institutions, enterprises, and intermediary agencies that do not implement the provisions for centralized bidding and procurement of drugs have not been severely investigated and dealt with. These problems have seriously affected the effectiveness of the centralized bidding and procurement of drugs, and the society strongly reflects this. In order to further improve the centralized bidding procurement policy for pharmaceutical products and standardize the centralized bidding and procurement of pharmaceuticals, the six ministries and commissions issued a joint circular to “Several Regulations on Further Regulating the Centralized Public Bidding Procurement of Medical Institutions” (hereinafter referred to as “Several Provisions”). The "Several Regulations" clearly stipulates the correction of the problems existing in the current centralized procurement of pharmaceuticals. The notice requires all localities to further improve methods and regulate management in accordance with the "Several Provisions." It is necessary to seriously study and solve the existing problems so that centralized procurement and bidding of drugs can play a greater role in rectifying the order of drug circulation, regulating the price of drugs, correcting unhealthy practices in the purchase and sale of medicines, and reducing the burden on medical expenses of the people. First, standardize the bidding and purchasing activities of drugs. Non-profit medical institutions affiliated to people's governments at the county level and above, state-owned enterprises (including state-controlled enterprises), etc. must all participate in centralized bidding and procurement of medicines for medical institutions. Second, expand the scope of centralized bidding and procurement of drugs. More than 80% of the pharmaceutical procurement expenditures of medical institutions (excluding Chinese Herbal Medicines) were included in centralized tender procurement. 3. When signing a drug purchase and sales contract with a successful bidder, a medical institution must specify the quantity of the purchase and strictly enforce it.
